Cali State Notary Power of Attorney Documents

Power of Attorney Signings
Power of Attorney signings may seem unique if you have never done one before. However, for an experienced Notary Public in California, they are quite common. We do them often for Wills & trust signings and Hospital signings.
When you have a Power of Attorney signed by a friend or family member you will need to make sure of the following before contacting Cali State Notary:

The signer granting Power of Attorney is aware of the document they will be signing and what it will do for them and their rights.

The signer granting Power of Attorney is in sound mind and body and will be able to sign the document after the Notary briefly explains the document.

The signer granting the Power of Attorney has a non-expired US-issued Driver's License or non-expired US-issued Passport. If the signer does not have one of these two forms of ID, the signer may need two credible witnesses. A credible witness is a person who is not listed in the documents and is not a blood relative to the signer (a disinterested party). That person must have one of the two types of identification documents listed above and under oath, the credible witness must swear or affirm that each of the following is true:

​The individual appearing before the notary public as the signer of the document is the person named in the document;

The credible witness personally knows the signer;

The credible witness reasonably believes that the circumstances of the signer are such that it would be very difficult or impossible for the signer to obtain another form of identification;

The signer does not possess any of the identification documents authorized by law to establish the signer’s identity; and

The credible witness does not have a financial interest and is not named in the document signed.

You will need to inspect your forms as well to ensure that you only need a Notary. Many Power of Attorney forms require two witnesses in addition to the Notary. If your form requires two witnesses and a Notary, you will need to make arrangements for the witnesses to be present.
