The signer must be coherent and willing to sign the document during the Notary appointment.
The signer must have a valid, non-expired US Identification Card, Driver's License or Passport. If the signer cannot provide these forms of identification, two credible witnesses can be provided. The credible witnesses must process valid IDs, not be related to the signer by blood, and not be named in the document. A Credible witness can be anyone over the age of 18 with no direct benefit from the document and must sign an affidavit in front of the Notary.
The signer should not be under any duress to sign the documents in any way.
Before booking, please make sure to inspect your documents carefully to see how many signatures are being notarized and double-check to see if any documents ( such as Power of Attorney or Health Care Directives) does not require additional witnesses. If the signing occurs at a Hospital, Senior Care Home, or Assisted Living facility, the witness can not be an employee of the facility, and the signing may require an Ombudsman to be present. Please Note, Cali State Notary can provide witnesses for an additional fee. Be sure to ask for them on the booking form.
